General Terms and Conditions

1. General stipulations, customers

1) All offers, contracts of sale and deliveries based on orders submitted by our customers by means of our online shop www.genet-import-export.com (hereinafter known as “online shop”) are subject to these General Terms and Conditions.

(2) The product range in our online shop is directed to consumers only. For the purpose of these General Terms and Conditions, a consumer means every natural person who enters into a legal transaction for a purpose that is outside his trade, business or profession (Section 13 German Civil Code – BGB).

2. Entry into contract, right of revocation and right of return, costs of return

(1) The presentation of goods in our online shop does not constitute a binding offer to enter into a contract of sale.

(2) By submitting an order in the online shop (for which a prior registration and the acceptance of these General Terms and Conditions are necessary), the customer makes a binding offer to purchase the pertaining product.

(3) Immediately after receiving the offer, we will send the customer a confirmation of receipt of the offer, which does not constitute an acceptance of the offer. The offer is only considered to be accepted by us as soon as we declare the acceptance to the customer (by e-mail) or consign the goods for shipment. The contract of sale with the customer only comes into effect when we have accepted the offer.

(4) Every customer is entitled to revoke his offer in accordance with to the particular instructions regarding his/her right of revocation conveyed to him/her during the course of submitting the order in our online shop.

(5) If as a customer exercises his/her rights of revocation and return pursuant to section 2 paragraph 4 of these General Terms and Conditions, he/she bears the costs of returning the goods, insofar as the price of the returned goods does not exceed forty euros. The customer also bears the costs when the price of the goods exceeds forty euros and the customer has intentionally or negligently not paid the price the price in part or full prior to revocation, unless the goods differ from those ordered.

3. Prices and payment, shipping costs

(1) Our prices include statutory value added tax, but not shipping costs. The customer bears shipping costs, customs and similar charges.

(2) From an order value of fifty-five euros upwards, we carry the costs of shipment within Germany for the customer.

(3) Unless expressly otherwise agreed, we deliver only on:
a) advance payment
b) payment by PayPal
c) payment by invoice.

4. Shipment of goods

(1) We will ship the goods to the customer within seven days of receipt of the order, in the case of advance payment in accordance with section 3 paragraph 2a) of these General Terms and Conditions following receipt of payment.

(2) If the goods should undeliverable or not deliverable on time in the sense of section 4 paragraph 1 of these General Terms and Conditions, we will immediately notify the customer. In such a case we will immediately refund any payments made to us by the the customer for those goods. The customer‘s statutory rights with regard to delayed delivery are not affected by the above provision.

(3) We are entitled to partial delivery of separately usable goods included in a single order, whereby we bear additional costs thus incurred.

5. Shipment

Unless expressly otherwise agreed, we will determine the appropriate shipping method and carrier at our reasonable discretion.

6. Retention of title

(1) We retain title of the goods delivered by us until we receive payment in full of the purchase price for the pertaining item (including value added tax and the costs of shipment).

(2) The customer is not entitled to resell any goods delivered by us that are subject to retention of title without our prior written consent.

7. Data protection

(1) We are entitled to process and store data relevant to the specific contracts of sale, insofar as this is necessary for the execution and completion of the contract of sale and as long as we are required by law to store these data.

(2) We are not entitled to collect, transmit or otherwise process personal data pertaining to the customer for any other purpose than those named in section 7 of these General Terms and Conditions..

8. Severability clause

Should any provision of these General Terms and Conditions be illegal, invalid or unenforceable, this does not affect the validity or enforceability of any other provision of these General Terms and Conditions.
